Accused-Baru Singh has filed this petition under Section 482 Cr.P.C. for issuance of directions to respondent No.2 to decide the representation dated 18.10.2018 (Annexure P-4), relating to the investigation in FIR No.14 dated 03.03.2018 under Sections 279/337/427 IPC registered at Police Station Dharamgarh, District Sangrur. On 03.03.2018, FIR was registered on the basis of the statement of respondent No.4-Gurjiwan Singh, which was in respect of a vehicular accident caused by the offending vehicle driven by accused (petitioner). It is pleaded that in the said accident, both the parties received injuries. After registration of the FIR, the petitioner also gave a representation on 18.10.2018 (Annexure P-4) and requested for proper investigation in the said FIR.
On 11.01.2019, learned State counsel was directed to furnish Sheetal Gawri 2019.07.17 17:28 I attest to the accuracy and integrity of this document Chandigarh the status of investigation in the above mentioned FIR.
CRM-M-827-2019 (O & M) -2In response, reply by way of affidavit of Deputy Superintendent of Police, Sub Division, Dirba, District Sangrur was filed on behalf of respondents No.1 to 3, wherein it is mentioned that the final report after completion of investigation is prepared and is to be filed as and when the petitioner is arrested. It is also pointed out that the representations given by the petitioner were looked into and a thorough enquiry was conducted wherein it was found that the accident in question was caused by the petitioner-Baru Singh. The conclusion of the enquiry into the representation is placed on record as Annexure R-1.
In view of the above response, it is apparent that the representations of the petitioner have been looked into and a detailed order has been passed and the representation has also been filed. In view of the above, nothing survives for adjudication in the present petition and the same is rendered infructuous. Dismissed as such.
