(ORAL) The contempt petition is filed for non-compliance of the order dated 04.08.2016 vide which respondents were directed to consider the matter at the highest level with respect to grant of promotion avenues for Dark Room Assistants to Radiographers and thereafter take an appropriate decision.

Reply has been filed. As per the said reply, the cadre of Dark Room Assistant has already been declared as dying cadre by the State Government on 27.06.2016 and a copy of the said memo has also been placed on record as Annexure R1. Further the new Rules 2016 mention that all posts of the Radiographers are to be filled up with 100% direct recruitment and it is also submitted that post of Radiographer is not promotional post for any post. Thus, the decision has been taken after due consideration at the highest level and necessary orders to the same effect has MEENU 2019.02.07 11:04 I attest to the accuracy and authenticity of this document chandigarh

In view of the same, this Court cannot hold that there is any contempt of the order dated 04.08.2016 is made out. The same is hereby dismissed.
