The instant contempt petition was filed with the allegations that despite directions of this Court dated 31.7.2017, the respondents had not decided his legal notice dated 11.11.2014 regarding pensionary benefits, within the stipulated time of three months from the receipt of a copy of the said order.

Notice of motion was issued.

In compliance of the order dated 28.11.2017 Mr.J.L.Ahuja, respondent no.2 is present.

Further, reply has also been filed on behalf of respondent no.2 by way of affidavit dated 9.1.2018 stating therein that after referring the matter to the Head Office of the respondent-Oriental Insurance Company, the necessary relief of family pension has been granted to the petitioner and conveyed to him vide letter dated 22.12.2017. COCP 3492/2017 reply filed, the instant petition has become infructuous. There is no representation on behalf of the petitioner. Keeping in view of the contents of the reply as also the statement of counsel for respondents, instant contempt petition is dismissed as infructuous.

However, in case of some factual error, petitioner is free to seek revival of the instant contempt petition.
