RITU BAHRI, J.(Oral) Petitioners are seeking issuance of directions to the respondents to determine the matter of inter se merit positions, in view of the judgment dated 26.03.2019 (P-6).

The greivance of the petitioners before this Court is that pursuant to advertisement dated 08.11.2012, the petitioners have obtained more marks in their category than the cut of marks and they joined as JBT teacher in different-2 schools. Petitioners are now seeking increments as granted to similarly situated person, who were appionted pursuant to the above advertisement. The result of the petitioners was declared in the year 2014 but till date the seniority position is not settled by the department. Issue notice of motion.

On asking of the Court, Mr. Kiran Pal Singh, AAG, Haryana accepts notice on behalf of the respondent-State. CWP No. 657-2020 decide the legal notice dated 29.05.2019/03.10.2019 (P-7), within a period of six months from the date of receipt of certified copy of this order. The respondent No. 3 shall pass a speaking order thereon after affording opportunity of hearing to the petitioners, failing which, respondent No. 3, shall be liable to pay cost of Rs.25,000/- each to the petitioners. This condition of imposing cost is only to prevent the petitioners to run from pillar to post and avail remedy of contempt in case of non-compliance of directions issued by this Court.
