JASWANT SINGH, J (ORAL) The petitioner is working as a part time Lecturer in History with the S.D Sr. Secondary School Narwana, District Jind since 1998. His grievance was that in spite of sufficient workload available in his subject, the post was not being sanctioned in the scale of full time Lecturer. Hence, he filed CWP No.11156 of 2015, which was disposed of by this Court vide order dated 28.5.2015 directing the official respondents to decide the question of conversion of the post of part time Lecturer in History into a full time post on the basis of workload in the aforesaid School. Since no order was passed within the stipulated time of three months from the date of receipt of a certified copy of the order, present contempt petition was filed.

Upon notice, reply has been filed whereby an order dated 26.10.2016 (R.1) has been passed rejecting the claim of the petitioner.

At the time of hearing also, a memo dated 11.1.2017

COCP No.576 of 2016 #2# issued by the Director, Secondary Education Haryana and addressed to the Advocate General, Haryana, Chandigarh has been placed on record wherein the position for non-conversion has been supplemented.

In view of the aforesaid, learned counsel for the petitioner prays for permission to withdraw this contempt petition to enable his client, if so advised, to seek his remedy in accordance with law.
