NIRMALJIT KAUR, J. (ORAL) The contempt is filed for non-compliance of the order dated 15.05.2017 vide which a direction was issued to consider claim of the petitioners for regularisation of their services as per 2011 Policy against the sanctioned full time regular posts of the same category as the petitioners which may be lying vacant in District Palwal as on date, as per their respective seniority.

Reply was filed. As per the said reply, case of the petitioners was considered and petitioner Nos.1 and 3 were found eligible as per the said Policy but they were not regularised as no vacancy was available. Thereafter, in pursuance of the last order, another reply by way of affidavit of Dr.Saket Kumar, Director General, AYUSH, Haryana, dated 22.02.2019 has been filed. As per the said affidavit, 45 posts are lying vacant with them. It is further stated that petitioner Nos.1 and 3 shall be appointed against these available vacancies. With respect to petitioner Nos.2, 4, 5 and 6, it is MEENU 2019.02.28 10:29 I attest to the accuracy and authenticity of this document chandigarh

COCP-3524-2017 -2stated in Annexure R-3, dated 31.07.2018 annexed with earlier reply that they are not eligible as per the Policy dated 29.07.2011. In view of the same, no contempt is made out. The same is hereby dismissed.

The rule issued against the respondent(s) stands discharged. However, in case the respondents do not grant regularisation to petitioner Nos.1 and 3 within four weeks from today, they shall be at liberty to revive the contempt petition.
