***** HARKESH MANUJA J. (Oral) Present petition has been filed under Section 439 Cr.P.C. seeking bail pending trial in case FIR No.99 dated 28.05.2022, under Section 379-B (2) IPC, registered at Police Station Beas, District Amritsar. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. Even, no injury to the complainant has been attributed to the present petitioner. He further submits that the petitioner is behind the bars for more than 7 months now, the investigation already stands concluded, challan filed and the trial is likely to take some time, thus, he deserves the concession of bail. On the other hand, learned State counsel submits that though the investigation already stands concluded, challan filed, however, he submit that one motorcycle without any number was recovered from the present petitioner and he thus, opposes the prayer made in the present petition. Considering the fact that the investigation already stands concluded, challan filed and no injury to the complainant has been attributed to the petitioner, no useful purpose is going to be served by extending the incarceration of the petitioner, who is in custody since 28.05.2022. In view of the above, without expressing any opinion on the mertis of the case, the present petition is allowed. Petitioner, namely, Bikramjit Singh is ordered to be released on bail, subject to his furnishing bail bonds and surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate.
