(ORAL) Learned counsel for the petitioner submits that the matter had been compromised between the parties and the statements of certain witnesses had also been recorded during trial. However, given the legal position and FIR under Section 304-A IPC; involving road accidents, which cannot be quashed on the basis of compromise. He further submits that he wants to withdraw the present petition with a direction to the trial Court to expedite the trial and also to permit recalling of the witnesses on filing an appropriate application in this regard before trial Court. Learned counsel appearing for the complainant has no objection to the aforesaid prayer.
Given above, the present petition stands disposed of having been withdrawn with liberty aforesaid.
It is clarified that it shall be permissible for the petitioner to file an application for recalling of the witnesses in accordance with law and the Court shall consider such application.
It is further clarified that the trial Court shall try to complete the trial on or before 31.03.2023.
