Learned counsel for the respondent submits that lease deed in terms of order dated 20.08.2013 passed in LPA-659-2009 was issued for the period 01.01.2014 to 3.12.2017 i.e. for three years. There is specific mention to this effect in para 4 of the lease deed as well. This deed was not for one year as presented by the petitioner, as such, this petition has been rendered infructuous.

In view of submission of learned counsel for the respondent learned counsel for the petitioner seeks permission to withdraw the instant petition.

It is, however, made clear that respondent shall be entitled to take any action for default of terms of the lease deed or any other action in accordance with law.
