Petitioners are working as Conductors with the Haryana Roadways Department. Their pay w.e.f. 1.1.2006 was refixed vide order dated 18.5.2012 thereby reducing their pay without following principles of natural justice. Writ petition bearing CWP No.24110/2012 filed by the petitioners was disposed of vide order dated 12.7.2016 directing the Authorities to pass a fresh order regarding refixation within four months after observing principles of natural justice. Consequently, a show cause notice dated 10.10.2016 was issued and on consideration was replied by a speaking order dated 11.11.2016 (P-5).

Counsel for the petitioners has argued that their basic pay has not been correctly fixed in terms of the provision 20 of Haryana Civil Service (Assured Career Progression)Rules,2008 and therefore, flouted interim directions.

After hearing counsel for the petitioners no case for invoking Rajinder Parshad Joshi 2018.01.17 18:27 I attest to the accuracy and integrity of this document

COCP 3564/2017 contempt jurisdiction is made out. Petitioners would be free to challenge the impugned order in accordance with law.
