(ORAL) Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner in case FIR No.732 dated 09.11.2019 registered under Sections 21C and 27A of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station City Hansi, District Hisar.

According to the prosecution, petitioner along with his wife is indulged in illicit trade of narcotics.

Learned counsel inter alia contends that petitioner is a neuro patient. He has three minor children. Wife of the petitioner is already in custody. Thus, there is none in the family to look after the minor children. Having given thoughtful consideration to the above submissions, this Court finds the instant petition completely devoid of any merit for the simple reason that petitioner has been named by his own wife, who was apprehended with conscious possession of 40 grams of smack RAVINDER SINGH 2020.01.14 15:55 I attest to the accuracy and integrity of this document

-2CRM-M-1044 of 2020 without any permit or licence for sale, as her accomplice that he procures the contraband and hands over the same to her for selling. Lower Court has rightly mentioned that source of procurement of contraband is to be traced out, for which custodial interrogation of the petitioner is necessary. At this stage, learned counsel for the petitioner prays that he may be allowed to withdraw this petition.
