Petitioner seeks pre-arrest bail in case FIR No.147 dated 05.11.2022 registered at Police Station Boha, District Mansa under Sections 324, 323, 34 (Section 326 IPC added later on). It is submitted by learned counsel for the petitioner that the parties are closely related to each other. Petitioner was earlier allowed bail before addition of Section 326 IPC. Later on, compromise (Annexure P.5) has been effected between the parties. On the basis of that compromise, quashing petition has already been filed.

Notice of motion.

On asking of the Court, Mr. R.S. Khaira, DAG, Punjab, accepts notice on behalf of respondent No.1 and Mr. Kuldeep Singh, Advocate accepts notice on behalf of respondent No.2 - complainant. Learned counsel appearing for the complainant admits the factum of compromise. Considering the aforesaid facts, the petition is allowed. Therefore, it is directed that in case of his arrest, the petitioner shall be released on bail subject to his furnishing bail

CRM-M-1549 of 2023 -2bonds/ surety bonds to the satisfaction of Investigating Officer. However, it is further directed that the petitioner shall join the investigation as and when so required by the Investigating Officer. He shall not contact any person associated with the case to dissuade him from the investigation in any manner whatsoever and nor shall leave the country without prior permission of the Court. He shall further comply with the conditions stipulated in Section 438(2) Cr.P.C.
