Prayer made in the present petition is for directing the respondents to release the service benefits of the petitioner i.e. leave encashment, gratuity etc.

Learned counsel for the respondents has drawn the attention of the Court to para 4 of the reply, to which there was no replication filed and reads thus:
"4. That the contents of the corresponding paragraph of the above titled petition are wrong and hence denied. That the petitioner was dismissed from the services of the Bank on his conviction for offences involving moral turpitude under Prevention of Corruption Act 1988 by the Hon'ble Court of Special Judge, CBI, Patiala, Punjab. That the petitioner was provided with Provident Fund amount but the gratuity was forfeited in view of the provisions of Section 4(6) of the Payment of Gratuity Act 1972 read with Central Bank of India Employees' Gratuity Fund Rules 1975 and leave encashment was denied in terms of Regulation 38 of Central Bank of India (Officers') Service Regulations, 1979."
