JASWANT SINGH, J (ORAL) The eviction petition of the petitioner-Veer Sain Jain (since deceased)/original owner of the suit property was allowed by both the courts below. Now, son of the petitioner has filed this contempt petition for punishing the respondent (tenant) for violating the order dated 21.5.2015 passed by this Court in CR No.1958 of 2005 whereby it was observed as under:

"Both the parties agree that the order of eviction will be confirmed and that the time of eviction shall be 12 months. The tenant shall pay all the past arrears of rent as per the memo which is circulated by the landlord and also pay rent @ ` 5,000/- from the month of June 2015 and shall continue to pay the said rent till the order of eviction. The past arrears at a paltry sum of ` 10/- as claimed, shall also be paid before the 5th of June 2015. The tenant is also required to file an affidavit of undertaking that he will surrender the possession of the property before 30.05.2016 and such an affidavit shall be delivered to this Court, within a week from the date of passing of this order. If there is a failure to comply with any of the directions given, either of past

At the time of hearing today, learned counsel for the petitioner points out that the present contempt petition has become infructuous as a compromise has been effected between the parties.
