***** JASJIT SINGH BEDI, J. (Oral) Petitioner seeks grant of the anticipatory bail under Section 438 Cr.P.C. in a case bearing FIR No.0114 dated 03.12.2021 under Sections 420, 120-B IPC, registered with Police Station Cantt. Bathinda, District Bathinda. On 13.01.2022, the following order was passed by this Court:- "Due to COVID-19 situation, the matter is taken up for hearing through Video Conferencing.

Learned counsel for the petitioner contends that the dispute revolves around an agreement to sell plot measuring 161 sq. yards in Baba Farid Nagar, Bathinda. In furtherance of the agreement to sell, the petitioner was paid an amount of Rs.50,000/- and thereafter, cheque of Rs.2,50,000/- and another amount of Rs.2 lakhs in cash, being dealer as the sale arrangements.

Learned counsel for the petitioner further submits that the dispute in the present FIR is in the nature of civil rights and even otherwise has forwarded the amounts so received by him to the seller, who was only acting as a Mediator between the dealer and seller.

Meanwhile, petitioner is directed to join the investigation within a period of one week and in the event of arrest, the petitioner be released on interim bail on furnishing surety and personal security to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions incorporated under Section 438(2) Cr.P.C." However, learned State counsel on instructions from ASI Jagtar Singh submits that the petitioner has joined investigation in terms of order dated 13.01.2022 and is not required for custodial interrogation. In this view of the matter, interim order dated 13.01.2022 is made absolute. However, the petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C. Petition stands disposed of.
