Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.166 dated 04.07.2018 under Section 302 IPC, registered at Police Station Julana, District Jind. Notice of motion.

Mr.Tanuj Sharma, AAG, Haryana, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that there is allegation against the petitioner that he gave beatings to his elder brother Baru Ram, who died. The injuries were ante mortem in nature as per opinion of the doctor in the post-mortem examination report. As per the FIR, the accused was residing VINEET GULATI 2019.02.27 16:27 I attest to the accuracy and authenticity of this document Chandigarh with Baru Ram. The petitioner is the only accused and has committed

CRM No.M-874 of 2019 -2murder of his brother.

Keeping in view the facts and circumstances of the present case and in view of the nature and gravity of the offence, I do not find it a fit case where petitioner is entitled to benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
