Petitioners filed CWP 4760/2013 alleging that possession of their land as mentioned in the petition had been taken taken and utilized by the respondents, it being located within the boundary wall of the Ammunition Depot at Dappar. They sought a direction for payment of compensation and damages for the use and occupation of their land by respondents. The said writ petition was disposed of vide order dated 8.10.2013 with a direction to Deputy Commissioner, Mohali to initiate the process in accordance with law to ensure that due amount of compensation/user charges is paid to the petitioners as early Rajinder Parshad Joshi 2017.05.10 15:25 I attest to the accuracy and integrity of this document

COCP No.778/2015 2 as possible but not later than one year from the date of the order. Now alleging disobedience of said order dated 8.10.2013 instant contempt has been filed.

Upon notice, today, reply by way of affidavit of Gaurav Kaushal,IDES,Defence Estate Officer,Chandigarh has been filed on behalf of respondents 2 and 3 stating therein that in CWP 16455/2016 titled as Inderjit Singh and others v UOI and others, involving similar facts, disposed of on 2.5.2017, this Court has accepted the stand taken by respondents wherein they have stated that sanction has already been granted by the Ministry of Defence for acquisition of land. Communication dated 25.4.2017 has been sent to D.C.,Mohali to initiate the process and conclude the same at the earliest. It is further stated that the process will take about one year. Copy of said order has been Annexed as Annexure R-3/2 with the reply filed today, which is taken on record.

In view of the above, in my opinion, the instant petition has been rendered infructuous.

Disposed of accordingly.
