(ORAL) The petitioner (Bhagwant Kaur) did not possess one of the essential qualifications of Certificate in Physical Education, while competing for the advertised post of PTIs. Her writ petition, challenging the action was allowed, holding that the petitioner had to be considered eligible as she possessed a higher qualification of Bachelor of Physical Education (B.P.Ed.), that was in line with the prescribed qualifications, and hence entitled to appointment, if found within the selection zone. Since the appointment was not given to the petitioner inspite of being falling within the selection zone, the instant contempt was filed. Now, the applicant-petitioner has moved an application bearing CM No. 20480-CII of 2019, seeking an uncodnitional withdrawal of the contempt in view of the respondent/State of Punjab having issued an appointment letter dated 01.11.2018 in respect of the petitioner as PTI.
