AT CHANDIGARH CWP-659-2019 Decided on : 27.11.2019 Vipin Kumar . . . Petitioner(s)
Versus
State of Punjab and others . . . Respondent(s) CORAM: HON'BLE MR. JUSTICE RAJAN GUPTA HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL PRESENT: Mr. S.S. Khaira, Advocate for the petitioner(s).
Mr. IPS Doabia, Addl. AG, Punjab.
**** RAJAN GUPTA, J. (Oral) This is a writ petition seeking Mandamus to direct the respondents not to conduct the elections, as the voters from the outside of the State were not deleted from the voters list pertaining to village Basowal Colony. At the outset, Mr. Doabia, learned State counsel has pointed out that the entire election process is now over. Notification regarding elected representatives has been issued and they are functioning. Thus, no cause of action survives in the present writ petition. He, however, assures the court that before the next elections for electing Sarpanch to the concerned village, the petitioner shall be granted an opportunity of hearing regarding inclusion or exclusion of voters or Ward Bandi. Counsel for the petitioner is satisfied with the aforesaid statement. Thus, no further direction is necessary. Petition is disposed of accordingly.
