**** Rajan Gupta, J. (Oral) As per the direction given in CWP-17402-1996, a speaking order dated 28.04.2016 has been passed by the department. Stand of the State is that the order has been complied with. Thus, prayer made in the petition has been rendered infructuous.

Learned counsel for the petitioner does not controvert the plea that the speaking order has been passed. He has, however, serious grouse against the manner in which the seniority has been fixed. He submits that he may be allowed to withdraw this petition with liberty to impugn the order whereby seniority has been fixed.

Dismissed as withdrawn with liberty as prayed for, if permissible in law.
