Services of the petitioner in the category of claimed handicapped quota were regularized w.e.f. 6.4.2014 vide order dated 19.5.2014 on the post of Senior Lab Attendant. The grievance of the petitioner in the CWP 11635/2017 filed by him was that he was still being paid a consolidated salary of Rs.7200/- per month instead of the pay scale admissible to the post. The said writ petition was disposed of vide order dated 25.5.2017 with a direction to DPI(SE)Punjab to decide his representation.

Since the needful was not done hence the present contempt. Learned State counsel on instructions from Parminder Singh, Sr.Asstt.DPI(SE)Punjab states that it was discovered that the petitioner being Orthopaedically handicapped was not entitled for regularization of his services against a post reserved for visually handicapped person and therefore vide subsequent order dated 14.3.2017 the services of the Rajinder Parshad Joshi 2018.03.08 11:46 I attest to the accuracy and integrity of this document

COCP 3827/2017 (O&M) petitioner have been dispensed with. She further states that for the intervening period from the date of regularization till the date of termination, arrears of salary after deducting the amount of consolidated salary have since been paid. It is conceded that the termination is, however, a subject matter of challenge before this Court. In view of the above, it is evident that the order stands complied with and no further action is warranted in the present contempt petition.
