Petitioner filed CWP 25210/2014 seeking a writ of mandamus directing the respondents to consider his candidature for appointment to the post of Sub Divisional Engineer (Civil).

The said writ petition was disposed by vide order dated 10.12.2014 (P-1) directing the respondents to consider the grievance of the petitioner made in his representation before the entire exercise of reappraisal was done.

Alleging disobedience of said order dated 10.12.2014 instant contempt has been filed.

At the time of hearing today,learned counsel for the petitioner concedes that after filing of the instant contempt, a speaking order has been passed on the representation of the petitioner. He further prays for withdrawal of the present petition so as to enable his client to challenge the said speaking order in accordance with law.
