Petitioner, a Class IV employee of National Fertilizers Limited was transferred from Panipat Unit to Vijaypur Unit. Aggrieved, he filed CWP 467/2017 challenging his transfer. After contest the said writ petition was allowed and his transfer orders stood quashed. Now instant contempt has been filed with the allegations that in reply to para 3 of the said writ petition, respondents in their reply made wrong averments duly supported by an affidavit. It is thus alleged that contempt has been committed by the respondents. Heard learned counsel and perused the paperbook including order dated 12.10.2017 passed in CWP 467/2017. The allegation now sought to be raised in the present contempt petition was not raised at the time of decision of the writ petition, as would be evident from the order dated 12.10.2017 passed in CWP 467/2017. In such circumstances, the petitioner cannot be allowed to invoke contempt jurisdiction to rake up the said issue by way of contempt petition. Dismissed.
