Respondent-Deepak Kumar is tenant of petitioners Vipan Kumar and Rajan Kumar and had filed a civil suit for injunction seeking to restrain the landlord/petitioners from interfering in his peaceful possession of the demised premises. The said suit was dismissed as withdrawn vide order dated 28.1.2015 passed by learned Civil Judge (Junior Division) Ludhiana in view of a written compromise entered into between the parties whereby the tenant had agreed to handover vacant possession of the demised premises by 31.12.2015. Since the tenant had not vacated and handed over vacant possession in terms of the compromise the present contempt has been filed with the averments that the respondent/tenant deserves to be hauled up in contempt proceedings for ignoring a written statement before the Court below.

Heard learned counsel for the petitioners.

Keeping in view the facts of the case no contempt is made out. It was suit of the plaintiff/tenant which was dismissed as withdrawn with Rajinder Parshad Joshi 2018.01.22 16:45 I attest to the accuracy and integrity of this document

COCP 3874/2017 liberty for its revival in case there was any violation of the terms and conditions. Concededly, the petitioners/landlord have filed an eviction petition for handing over of the vacant possession of the demised premises. Dismissed.
