RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Article 226 of the Constitution of India praying for issuance of writ in the nature of mandamus directing respondents to consider claim of the petitioner for grant of cash compensation in lieu of allotment of land, the petitioner being the widow of Naib Subedar, Mukand Singh, who was permanently disabled due to the injuries caused by a mine blast during the 1965 Indo-Pak war. In this case notice of motion was issued on 14.01.2021. In response to the same the respondents have filed their reply wherein it has been submitted that grievance raised by the petitoiner in this petition was found to be genuine in the meeting held on 11.05.2023 and thus the petitioner has been found entitled to 3rd installment, amounting to Rs.15.00 lakhs.
Learned counsel for the State has submitted, on instructions, MEENU 2023.08.25 18:33 I attest to the accuracy and integrity of this order/judgment
CWP-933-2021 -22023:PHHC:111863 that 3rd installment amounting to Rs.15.00 lakhs would be paid to the petitioner within two months.
In view of the same, the present petition is disposed of with a direction that the due amount of 3rd installment be paid to the petitioner within two months from today. However, the petitioner is at liberty to avail her remedy as available to her under the law in case respondents fail to honour this undertaking.
