AT CHANDIGARH COCP 449/2017 DATE OF DECISION:09.07.2018 Amarjit Singh ....................Petitioner v Nand Kishore .....................Respondents Coram:- Hon'ble Mr.Justice Jaswant Singh Present:- None Jaswant Singh,J.(Oral) Petitioner is seeking initiation of contempt proceedings against respondent-Nand Kishore for not honouring his part of the compromise statement(P-3) on the basis of which FIR No.87/2011 dated 9.4.2011 for offences under Sections 406/471 and 120-B IPC, PS Sector 36 was to be quashed and further the appeal filed by the petitioner against respondent in a suit for specific performance was disposed of by learned District Judge,Chandigarh vide order dated 20.12.2016 and compromise was made part of the decree sheet.
Vide order 28.2.2017 notice of motion was issued for 8.5.2017. On 8.5.2017 the matter could not be taken up and was adjourned to1.8.2017. On 1.8.2017 nobody appeared for the petitioner and since service upon respondent was not complete for want of correct address, petitioner was directed to furnish correct address of the petitioner and the matter was listed Rajinder Parshad Joshi 2018.07.16 14:47 I attest to the accuracy and integrity of this document
COCP 449/2017 for 26.10.2017. On 26.10.2017 neither anybody put in appearance on behalf of the petitioner nor directions dated 1.8.2017 were found to have been complied with and hence the matter was adjourned to 12.2.2018. On 12.2.2018 the matter could not be taken up and was adjourned for today. Again today neither anyone has put in appearance on behalf of the petitioner nor correct address of the respondent furnished. In this view of the matter, it is apparent that the petitioner is not interested to pursue the instant petition.
Dismissed for non-prosecution.
