The petitioners are legal representatives of Late Azad Singh Rana, whose land situated in Village Chauma, Tehsil and District Gurugram was acquired upon an award announced on 20.6.2012. Said Azad Singh filed CWP 1578/2015 challenging the acquisition which was disposed of with certain directions vide order dated 21.12.2015. Although said Azad Singh had received the compensation and filed references for enhancement under Section 18 of the Land Acquisition Act, however, opted for benefit of Land Pooling Scheme dated 31.1.2016 in terms of direction (i) of the order dated 21.12.2015. Said Azad Singh is stated to have died on 2.12.2016. Thereafer his legal representatives filed CWP 3855/2017 challenging the option of Land Pooling by their father and choosing instead for allotment of alternative plot as oustees as also enhanced compensation granted by the Reference Court.

Present contempt has been filed alleging that interim order Rajinder Parshad Joshi 2018.03.01 11:17 I attest to the accuracy and integrity of this document

COCP 406/2018 dated 1.5.2017 passed in CWP 3855/2017 filed by the petitioners/legal representatives of Azad Singh has been violated inasmuch as the HUDA authorities have proceeded to raise construction on the acquired land including that of the petitioners without first allotting oustees plot. At the time of hearing counsel for the petitioners prays for withdrawal of the present contempt as CWP 3855/2017has, in the meanwhile, been disposed of vide order dated 12.2.2018 and the interim order having merged in the final order.

In view of the above,dismissed as withdrawn.
