The writ petition filed by the petitioner was disposed on 14.12.2016 setting aside the order dated 29.11.2013 whereby the suspension period from 19.11.2007 to 12.12.2007 and 13.12.2007 to 09.01.2008 was treated as 'no work no pay' period. The respondent was directed to pass fresh order in view of judgment of Balkar Singh Vs. State of Punjab and others reported as 2016(4) SCT 563. The needful was required to be done within two months from the date of receipt of certified copy of the order. On 07.02.2018, notice of motion was issued. Today, learned State counsel states that she has no instructions to appear for the respondent.
On asking of the Court, Mr. Shantanu Bansal, Advocate who is present in the Court, accepts notice on behalf of the respondent. Copies of paper book are supplied to him. The contempt petition is disposed of with the direction to the respondent that compliance of order of this Court dated 14.12.2016 passed in CWP No.23737 of 2014 shall be done within four months from today.
However, it is clarified that if needful is not within time specified by this Court, petitioner would be at liberty to revive the contempt petition.
