Mr. Yash Pal Gupta, Advocate, for the petitioner. RAJESH BINDAL, J The prayer in the present petition is for restoration of the name of the petitioner-company with the Registrar of Companies, which was struck off vide Gazette of India dated 8.9.2007.

It is not in dispute that the petitioner-company was incorporated on 26.9.1994. The claim of the petitioner is that the company is carrying on business ever since then. It continued business even after its name was struck off by the Registrar of Companies. He further did not dispute the fact that even since the company was incorporated, no return was filed with the Registrar of Companies.

Considering the totality of facts, where the company itself is a chronic defaulter under the Companies Act, 1956, I do not find any reason to accept the petition for restoration of the name of the petitioner-company. The petition stands dismissed. Consequently, the accompanying applications are also dismissed.
