Jaswant Singh,J(Oral) Petitioner /plaintiff is claiming initiation of contempt proceedings for the alleged violation of judgment and decree dated 22.1.2004 whereby respondents were restrained from disconnecting the electricity and water supply to his residence. It is claimed that the said decree had become final. In the execution petition filed for enforcing the decree, a conditional interim order dated 23.9.2016 was passed directing the judgments debtors/Union of India and Garrison Engineer, Ambala Cantt for restoring the electricity.

It is alleged that directions dated 23.9.2016 have thus been violated as the needful in terms of the interim direction has not been done. It is conceded that the interim directions dated 23.9.2016 (P-8) stood merged in the final order dated 25.10.2016 passed by the Executing Court whereby the execution application filed by the petitioner/plaintiff/decree holder itself was dismissed and the petitioner has availed the remedy of filing of a civil revision before this Court, wherein Rajinder Parshad Joshi 2017.01.16 17:51 I attest to the accuracy and integrity of this document

COCP 54/2017 notice of motion has been issued for 31.1.2017. After arguing for sometime and having failed to convince the Court, learned counsel prays for permission to withdraw the present contempt petition.
