Present petition has been filed by the petitioner for quashing of the complaint No.COMI/7/2022 dated 24.01.2022, titled as "Gurtej Singh versus Sukhchain Singh and others", pending before the learned Judicial Magistrate 1st Class, Moga, along with the summoning order dated 16.09.2023 passed by JMIC, Moga, whereby the petitioner along with the other co-accused has been summoned to face trial under Sections 323, 500,. 504, IPC.

Admittedly, at the first instance, petitioner has not approached to the Court of Sessions, by filing revision petition for the purpose of challenging the complaint/summoning order.

Therefore, counsel for the petitioner prays for withdrawal of the present petition with liberty to file a revision petition before the Court of Sessions. However, he prays for early disposal of the revision petition on merits, without adhering to the delay, in filing of the same. Counsel further submits that since, one of the accused Jaspreet Singh is in abroad, and on that account, trial could not proceed, therefore, the delay caused in filing of the revision petition would be of no consequence.

Taking into consideration the assertion made by counsel for the petitioner, present petition is disposed of as having been withdrawn. However, liberty is granted to the petitioner to challenge the complaint/summoning order within a period of three weeks from today, and on filing such revision petition within the specified period, same would be disposed of finally on merits, in accordance with law, by the revisional Court, within the period of next three months.
