Petitioner filed CWP 7293/2016 praying for a writ of mandamus to consider him for appointment to the post of HCS (Executive Branch) on account of his selection pursuant to advertisement dated 24.1.2004,which was held in abeyance due to a pending Vigilance Enquiry as nothing was found against the petitioner. The said writ petition was disposed of by this Court vide order dated 23.4.2016 with a direction to respondent to decide petitioner's representation dated 14.3.2016 by passing a speaking order within a period of three months, in accordance with law. Alleging disobedience of said order dated 23.4.2016 instant contempt has been filed.
At the time of hearing today, reply by way of affidavit of answering respondent has been filed stating therein that the representation of the petitioner stood decided vide order dated Rajinder Parshad Joshi 2017.04.27 18:01 I attest to the accuracy and integrity of this document
COCP 556/2017 24.3.2017(A-1). Delay in deciding the representation has also been sufficiently explained while tendering an unconditional apology for the same. The reply is taken on record.
In view of the contents of reply, it is apparent that the instant contempt has been rendered infructuous. Petitioner, if so advised, may challenge the speaking order A-1 in accordance with law. Ordered accordingly.
