Jaswant Singh,J(Oral) Petitioner was respondent in CWP 13800/2010 filed by collaterals/ the other party channeling the mutation proceedings regarding agriculture land based on some registered Will of their ancestor. It transpires that a compromise between two rival parties/relatives was arrived at vide written compromise dated 5.9.2014 (P-4) herein resulting into disposal of the aforesaid CWP 13800/2010 vide order dated 13.5.2015, whereby the writ petition itself was dismissed as withdrawn in the light of compromise.

Applicant/petitioner herein being one of the respondents in CWP 13800/2010 asserts that other party is not abiding by the terms of the compromise after having availed the benefit under that compromise. After arguing for sometime and realising that no contempt is made out, learned counsel prays for permission to withdraw the present contempt petition to enable his client to seek appropriate remedy in accordance with law.
