Prayer in the instant petition filed under Section 482 Cr.P.C. seeking direction to respondents No.1 and 2 to hand over the investigation of FIR 0321 dated 22.11.2020 under Section 306 IPC, registered at Police Station Salem Tabri, Ludhiana (Annexure P-3) to some senior IPS Officer or Crime Branch.

Status report dated 24.03.2023 by way of affidavit of Assistant Commissioner of Police (North) Ludhiana as well as status report dated 26.04.2021 by way of affidavit of Assistant Commissioner of Police (North) Ludhiana, on behalf of respondents No. 1 to 3 has already been filed and the same are taken on record.

Though the status reports have been filed twice before this Court as has been observed in the earlier part of this order, Mr. J.S. Rattu, DAG, Punjab, on instructions, received from Hardev Singh, ASI, would inform that cancellation report has already been presented before Illaqa Magistrate on 07.09.2022 and the same is pending for further consideration. In the light of the above, the petitioner is having remedy to file his protest petition, if the Court concerned, agrees with the cancellation report, before the competent Court.

In view of the same, learned counsel for the petitioner prays for withdrawal of the instant petition with the liberty, aforesaid. 6.
The prayer is accepted and he is permitted to withdraw the same with the liberty, aforesaid.
