Jaswant Singh,J(Oral) Petitioner filed CWP 19980/2016 seeking a direction for exchange of plot and grant of alternative plot due to the pending litigation regarding the allotted plot between HUDA and landowners. The claim was based in terms of policy dated 16.4.2009 and the said writ petition vide order dated 26.9.2016 was concededly got disposed of with a direction to the Estate Officer, HUDA,Gurgaon for deciding the pending application in terms of the said policy.

At the time of hearing, it is conceded by the counsel for the petitioner that in terms of the policy dated 16.4.2009 the competent authority would be Chief Administrator,HUDA,whereas the directions were got issued, inadvertently to the Estate Officer, HUDA. In view of the above,counsel for the petitioner prays for permission to withdraw the present petition with liberty to petitioner to avail her appropriate remedy in accordance with law.
