Present contempt has been filed alleging disobedience of the order dated 6.9.2017(P-1) whereby respondent was directed to take a decision with regard to payment of interest to petitioner on delayed payments of gratuity and leave encashment and in case petitioner was found entitled for the same the amount was to be paid within a period of 45 days. From the pleadings of the instant contempt it is apparent that speaking order P-6 has been passed and even the liability has also been acknowledged, however payment is not being released due to financial constraints. Hence the present contempt.

After arguing for sometime and having failed to convince the Court,learned counsel seeks permission to withdraw the petition at this stage.

Dismissed as withdrawn at this stage.
