This Court while issuing notice of motion on 16.2.2018 passed the following order:- "It is contended that neither an FIR is being registered against Gava Singh,Labh Singh and Lachhman Singh sons of Roop Singh residents of Village Burj Mehma,Tehsil and District Bathinda,at the complaint of the officials of PSPCL nor police help is being provided for installing the transmission line to the tube well connections of the petitioners in the fields. Notice of motion to respondents 1 and 2 only at this stage. At the asking of the Court,Mr.Manoj Bajaj,Addl.AG Punjab accepts notice and prays for time to seek instructions." Mr.Bajaj has filed an affidavit dated 6.3.2018 of Sh.Naveen Singla,IPS, SSP Bathinda.

In the affidavit it is stated that electricity/ tube well connection has been got restored qua agriculture land of Hardeep Kaur whereas qua Jagsir Singh, the connection at the order of PSPCL was not required to be restored as the same stands cancelled on account of being situated in the land belonging to Gram Panchayat. COCP 559/2018 (O&M) 4180-81-CII/2018 has been filed by the applicants/petitioners for impleading the officials of PSPCL as also certain documents to show that the removal of transformer and consequent disconnection of electricity/tube well connection qua Jagsir Singh has been illegally resorted to without following any procedure. It is alleged that the same is at the instance of Gava Singh and party, who on account of their influence have also been exonerated on the report dated 20.2.2018 of Junior Engineer qua the theft of transformer and other electrical appliances, contrary to a report submitted before by senior officer of the rank of Deputy Chief Engineer.

Be that as it may, as far as the compliance of order dated 25.10.2017 passed by this Court is concerned the respondents have shown due compliance. However, petitioner Jagsir Singh would be free to seek his remedy in accordance with law qua his claim as also regarding alleged theft of transformer etc., based on the report of Deputy Chief Engineer.

Disposed of with the above observations.
