HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No. 21 dated 13.03.2019, under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Mahilpur, District Hoshiarpur.

As per allegations in the FIR, 19 injections of Buprenorphine IP (Leefgesic) (2 ML) were recovered from the petitioner. Learned counsel for the petitioner contends that petitioner has falsely been roped in and that no recovery was effected from the petitioner. The petitioner is in custody since 13.03.2019 and the trial is not making any head-way due to Covid-19.

Opposing the petition, the learned State counsel has submitted that challan has been presented and the charges have been framed. Without commenting anything on the merits of the case and also bearing in mind the custody period, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Rakesh Kumar is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
