Prayer is for grant of regular bail in case FIR No.86 dated 05.09.2018 under Section 15 of NDPS Act registered at P.S Sadar Kotkapura, District Faridkot.
As per allegations in the FIR, 54 kg of poppy husk was recovered from the petitioner.
Learned counsel for the petitioner contends that the alleged recovery of contraband is marginally higher than the commercial quantity and that the petitioner is in custody since 05.09.2018. Opposing the petition, the learned State counsel has submitted that out of 19, 05 prosecution witnesses have already been examined. Without commenting anything on the merits of the case and also bearing in mind the fact that the petitioner is in custody since 05.09.2018 in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted.
