The petitioner was working as Assistant Accountant/Cashier with State Bank of India and on conclusion of disciplinary proceedings he was dismissed vide order dated 27.2.2013. The suit filed by the petitioner assailing the punishment order was decreed. However, the same was set aside by the First Appellate Court while allowing the appeal of the defendant/Bank. Subsequently, second appeal filed by the plaintiff/ petitioner was allowed vide judgment and decree dated 11.7.2016 passed by this Court whereby the decree passed by the Trial Court was restored. It is averred that part of the relief has been granted, however, promotion to the next higher post has been denied although consequential benefits were required to be released.
At the time of hearing, realizing that the decree is executable and therefore, contempt would not be made out, counsel prays for permission to withdraw the petition to enable the petitioner to seek Rajinder Parshad Joshi 2018.02.19 17:05 I attest to the accuracy and integrity of this document
