Present petition under Section 438 Cr.P.C. read with Section 482 Cr.P.C. for seeking pre-arrest bail to the petitioners in the complaint pending before respondent No.2-Deputy Superintendent of Police, District Shri Muktsar Sahib, filed by respondent No. 3-Inderjit Singh. Learned counsel for the petitioners fairly conceded that though no FIR has been registered against the petitioners, but they are being repeatedly called to the police station and harassed on the basis of complaint having been made by respondent No.3 and they have reasonable apprehension of their arrest in this false case. Notice of motion.

Criminal Misc. No. M-1631 of 2019 In view of the matter that no FIR has yet been registered, present petition for grant of pre-arrest bail to the petitioners is not maintainable. However, the instant petition is disposed of with the observation that in case petitioners are to be arrested in this case, they shall be given a written notice of five days before effecting their arrest.
