Petitioner retired as Lecturer(English) from Education Department,Haryana on 30.11.2015. While refixing his pension, a recovery of Rs.59385/- was ordered to be made from his pension and order to that effect was sent by Accountant General,Haryana to Treasury Officer,Bhiwani.

Aggrieved against the same, petitioner approached this Court by way of CWP 27179/2016. Vide interim order dated 23.12.2016 passed by this Court in that petition, aforesaid recovery was stayed.

In the instant contempt it is alleged that despite stay granted by this Court, on 30.12.2016 the pension of the petitioner was remitted to bank after making a deduction of Rs.5000/- which is in violation of the order dated 23.12.2016 passed by this Court. COCP 63 of 2017 Notice of motion was issued.

On 16.2.2017 during the course of hearing of present contempt petition, learned State counsel prayed for one opportunity to refund the recovery made prior to the knowledge of the stay order passed by this Court.

At the time of hearing, short reply by way of affidavit dated 8.3.2017 of Jaljit Singh Suhag,Treasury Officer,Bhiwani has been filed stating therein that pursuant to the undertaking given on 16.2.2017 a sum of Rs.20,000/- alongwith regular pension for February 2017 has been credited in the account of the petitioner on 1.3.2017. In view of the reply filed, learned counsel for the petitioner concedes that the instant contempt petition has been rendered infructuous.

Dismissed as infructuous.
