Petitioner-wife claims that respondent/husband has committed contempt of Court by not depositing a sum of Rs.10 lacs in terms of the interim order dated 24.10.2017 in CR 3983/2017 filed by the husband assailing order of the Trial Court under the Domestic Violence Act granting interim maintenance at the rate of Rs.5 lacs per month to the wife. Counsel for the petitioner heard.

It is not disputed that in the revision filed by the husband assailing grant of maintenance at the stated rate, while issuing notice of motion, this Court had directed payment of Rs.20 lacs out of total arrears of Rs.30 lacs and the same were deposited by the husband. On the subsequent date the Court directed deposit of another sum of Rs.10 lacs before the next date of hearing.

It is urged that the respondent/husband has not deposited the said amount and therefore has committed contempt of Court. The plea is not tenable as for the non-deposit of said amount Rajinder Parshad Joshi 2018.02.21 18:08 I attest to the accuracy and integrity of this document
