(ORAL) Present petition has been filed with a prayer that the petitioner is apprehending danger to his life and liberty as well as to his property at the hands of respondents No.5 to 13 and a direction be issued to respondents No.2 to 4 to protect the same. After the notice was issued, the respondent-State has filed a reply, in which, the following averments have been made in paragraphs No.
3 and 4 of the preliminary submissions: - "That on the basis of representation of the petitioner, the matter was inquired by ASI Fakruddin who recorded statement of Abid, Rati Khan, Jabir, Zaheer Abbas, Tarnul Hussain etc. After inquiry, facts arrived on record that Khubi son of Jassu who was receiving rent of the shop of the petitioner. Now said shops are lying vacant except one spare part shop which is running by Tajmul Hussain on rent from last three years and alleged person namely Jabid, Wasim, Paveena, Tabbasum etc. who ran away from the village Badkhal. In this regard, report of ASI Fakruddin was NARESH KUMAR 2021.08.
CRWP-415-2020 -2forwarded by in-charge Crime Branch Sector-56 on 15.04.2019 and said report was seen and file by competent authority. 4.
That keeping in view the facts and circumstances stated above, allegations made in the present petition were found false, however PCR in-charge of the area was directed to provide police help as or when required by the petitioner and his family members and as such the present petition of the petitioner is not maintainable and liable to be dismissed."
Learned counsel for the petitioner submits that even as of now also, petitioner is receiving threats, hence, he prays that petitioner be granted liberty to approach the police by filing an appropriate representation raising the said grievances and bringing the incidence of threats to the knowledge of the police.
Learned State counsel submits that in case any representation is filed by the petitioner to the police raising any said grievances and substantiating the allegations, the appropriate order will be passed by the police on the said representation within a period of four weeks from the date of receipt of the said application/representation. Learned counsel for the petitioner submits that keeping in view the above-said undertaking given by learned State counsel, petitioner does not want to press this petition any further and the same may be disposed of as such.
