**** RAJ MOHAN SINGH, J.(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.30 dated 30.01.2018, registered under Sections 15, 16, 20, 61 of the NDPS Act at P.S. Uchana, District Jind, Haryana.
Earlier petition bearing CRM-M No.49664 of 2018 was got dismissed as withdrawn on 14.01.2020. Thereafter CRM-M No.21161 of 2020 was also got dismissed as withdrawn on 25.09.2020.
As per prosecution case, the FIR was registered on the basis of secret information. The information was received qua the petitioner that he was running a Hotel under the name and style of Sharma Hotel near Bus Stand, Ghanso and was MOHMED ATIK 2021.09.15 18:15 I attest to the accuracy and integrity of this document
CRM-M-2031-2021 involved in selling poppy husk from his Hotel. The FIR was registered. Raid was conducted and the petitioner was apprehended from the Hotel. Six plastic bags with mark Annapurna Brand Best MP Special Wheat printed thereon and open plastic bags of green and yellow colour were recovered. Five plastic bags were found containing poppy husk having weight of 20 kgs. each. One bag was having 17 kgs. of poppy husk, whereas other bags of green and yellow were found containing 5 kgs. of ganja. Total 117 kgs. of poppy husk and 5 kgs. of ganja were recovered from the hotel premises of the petitioner. During course of investigation, the petitioner nominated Karambir @ Nakli as co-accused.
Recoveries are of commercial quantity. The earlier bail applications were withdrawn after arguing the case for some time. The prayer made by the petitioner at the time of withdrawal of petition bearing CRM-M No.49664 of 2018 was that the trial Court be directed to expedite the trial of the case. Finding no ground to interfere in the present case, the same is dismissed. However, the trial Court shall make every endeavour to conclude the trial at the earliest in accordance with law.
