JASWANT SINGH, J (ORAL) There is a serious matrimonial dispute between the petitioner-husband and the respondent-wife.
The present contempt has been filed alleging that the respondent-wife on 18.2.2017 had made a statement before the learned Civil Judge (Jr. Division), Chandigarh in the proceedings under the Domestic Violence Act and the maintenance proceedings to the effect that a sum of Rs.60 lacs deposited by the husband-Eshan Joshi in her Bank Account in ICICI Bank Account No.007601536392 Branch Bangalore would not be withdrawn or utilized, however, the said amount already stood withdrawn from the said Bank Account prior to that date.
Upon notice, respondent-Suman Joshi has filed her
COCP No.697 of 2017 #2# reply dated 18.4.2017 in Court, a copy of which has been furnished to counsel opposite.
After hearing learned counsel for the petitioner and respondent-wife in person, an undisputed fact, which has emerged, is that the JMIC, Chandigarh before whom the statement dated 18.2.2017 was made by the respondent-Suman Joshi has already commented upon the intention of the parties vide order dated 06.3.2017, which is subject matter of challenge before this Court in CRM-M-32351 of 2016.
In view of aforesaid, no case is made out qua disobedience, at this stage.
