The petitioner had approached this Court raising a challenge to the Notice dated 05.01.2023 (Annexure P-1) to the extent whereby the petitioner has been ordered to be absorbed as Technician-III/Power in the pay band of Rs. 5200-20200 with Grade Pay of Rs. 1900/- Level II (Lower Grade Pay) despite the fact that petitioner has been working in Pay Band Level-IV with Grade Pay of Rs. 2400/- 2.

A preliminary objection was raised by the respondents that the petitioner being a Central Government Employee, he has an efficacious alternative remedy of preferring an original application before the Central Administrative Tribunal.

Learned Counsel for the petitioner was confronted with the said objection by this Court as noticed in the order dated 21.11.2024 whereby the Counsel for the petitioner sought some time. The matter was thereafter adjourned to 25.11.2024, even on the said date, Counsel for the petitioner prayed for some time to advance arguments. The hearing was accordingly deferred for today. No one has chosen to enter appearance on behalf of the petitioner or to respond to the specific objection as regards alternative remedy available to the petitioner. The objection thus remains unopposed. 4.

The present writ petition is accordingly disposed of at this stage with liberty to the petitioner to take recourse to the alternative remedy of approaching the Central Administrative Tribunal. Needless to mention that in the event of the petitioner approaching the Central Administrative Tribunal against the grievance, the period spent in pursuing the present writ petition shall be taken into consideration while computing limitation.        +' &  (.
