The revision petition is against an order of arrest directed by the Motor Accident Claims Tribunal in execution of the award passed against the owner of the vehicle. The owner appears to have preferred appeal before this Court and there has been no stay granted and only notice has been issued in the application for stay. It will be no consolation for holder of decree to secure the paper to merely have an award given by a Court with no scope for recovery. The Tribunal has taken note of the fact that the petitioner is a person of means who owns a tractor and who has adequate resources to make the payment. The counsel states before me that the property will itself be a security and he shall not be compelled to make any payment. The property security can still be no consolation for a person who wants the money for the life lost. There is no error in directing arrest of person who has the means to pay but he is unwilling to pay by some lame excuses.
