Mr. Jateshwar Singh, Advocate for Mr. G.S. Chahal, Advocate for the petitioner. JASWANT SINGH, J (ORAL) The petitioner, who was holding the rank of Superintendent Grade II on substantive basis with the Department of Rural Development and Panchayats, Punjab, retired on 30.11.2006. He filed writ petition bearing CWP No.639 of 2008 claiming pay of the higher post and consequent retiral benefits for holding independent charge of Supdt Grade-I, O.S.D and Administrative Officer during his service period, which was disposed of by this Court on 22.1.2009 observing that the respondents may determine the claim of the petitioner, in the light of judgment dated 23.8.2004 of Division Bench passed in CWP No.6723 of 2004, besides paying all benefits within a period of three months.
The petitioner by preferring this contempt petition has alleged the respondents to be guilty of having willfully disobeyed a direction contained in the order aforesaid.
COCP No.704 of 2017 #2# At the time of hearing today, learned counsel for the petitioner prays for withdrawal of the present contempt petition to enable his client to file fresh one by impleading the present incumbent as the stated respondent has since been transferred. Dismissed as withdrawn with the liberty aforesaid. Rule is discharged.
