The present contempt was filed for the alleged violation of the directions contained in the order dated 14.8.2015 passed by a Division Bench of this Court whereby the undisputed amounts of refund, as per assessment orders passed by the adjudicating authority itself, for the financial years 2008-09 and 2010-2011 had not been released. On the directions passed by this Court, learned State counsel had sought instructions. At the time of hearing today, she on instructions from AETC,Kapurthala, namely Mr. Paramjit Singh, states that aforesaid refund for the two financial years has been released by issuance of vouchers and the admissible amounts towards interest for the delayed payment of the aforesaid refunds have since been calculated and sent for approval and consequent release. She further assures that the needful shall be done within next four weeks.

COCP 666/2018 In the light of the stand of the respondents, counsel for the petitioner concedes that no further proceedings are warranted in the present contempt petition.

In view of the aforesaid stand of the respondents, present contempt petition is disposed of with a direction that the respondents shall positively release the aforesaid amount of interest within eight weeks from today failing which the petitioner shall be entitled to seek revival of the present contempt and the officer concerned shall be liable to pay personally costs of Rs.50,000/- to the petitioner.

Disposed of in the above terms.
